All the economic operators envisaged by art. 45 of Legislative Decree no. 50/2016, including competitors specifically and temporarily grouped pursuant to art. 45, paragraph 2, lett. d) of Legislative Decree no. 50/2016 and aggregations between companies participating in the network contract pursuant to art. 45, paragraph 2, lett. f) of Legislative Decree no. 50/2016.

a) For temporary groupings of companies, under penalty of exclusion, the following is required:

1. R.T.I. not formally established for participation in the tender:

— the request must:

—— be signed jointly by the legal representatives of all the companies constituting the grouping;

—— specify the parts of the service that will be performed by the individual companies (the agent, in any case, must meet the requirements and perform the services to a majority extent, pursuant to Article 83, paragraph 8 of Legislative Decree No. 50 / 2016);

—— indicate the company that will take on the role of agent;

—— contain the commitment that, in the event of the award of the tender, the same companies will comply with the provisions of art. 48 of Legislative Decree no. 50/2016;

— each company that constitutes the Grouping must enclose its own documentation, as prescribed in the following point III.2.

2. R.T.I. formally established for participation in the tender:

— notarial deed from which, among other things, it results:

—— the conferral of the special collective mandate with representation to the company from among those gathered as qualified;

—— the specification of the parts of the service that will be performed by the individual companies (the agent, in any case, must meet the requirements and perform the services to a majority extent, pursuant to Article 83, paragraph 8 of Legislative Decree no. 50/2016);

— the application must be signed by the legal representative of the mandate company,

For the purposes of qualification, the articles 48 and 83 of Legislative Decree no. 50/2016.

Posizione economica e finanziaria:

Each competing company (even if auxiliary or principal) must produce, together with the application form, two suitable bank declarations.

Capacità tecnica e professionale:

Economic operators, including those assembled, retisti and / or consortium members or auxiliaries, in possession of the service phases specified in para. II.1.5), are considered to be all essential. To this end, each competitor must produce the following documents:

To. declaration, signed by the legal representative, certifying the list of all collective catering services provided and invoiced to private individuals, entities or public administrations in the years 2015-2017, differentiated by year and with indication of the dates and numbers of the related contracts, beneficiaries (public or private), invoiced amounts (excluding VAT) whose annual average must be equal to at least 1.5 times the annual value of the lot (excluding VAT) for which it is asked to participate. In the case of application for both lots, the specific turnover requested must be at least 1.5 times the annual value (excluding VAT) of lot 2. In case of RTI it is necessary to specify the phase / part / quota performed by the individual economic operator in the same supply;

b) self-certification, signed by the legal representative, certifying compliance with the standards UNI EN ISO 9001-2015, valid, issued by ACCREDIA accredited body or other entity in mutual recognition, relating to the accreditation sector for each essential phase, entrusted to the single economic operator;

c) self-certification, signed by the legal representative, certifying the possession of the EMAS certification (Regulation No. 1221/2009 on the voluntary participation of organizations in a community eco-management and audit system) or ISO 14001, valid, issued by an accredited body ACCREDIA or another body in mutual recognition, for each essential phase;

d) self-certification, signed by the legal representative, certifying the possession of the certification, valid and issued by an accredited certification body, certifying the adoption of management systems for food safety in compliance with the ISO 22000 standards (referring only to the purchase of foodstuffs, raw materials, semi-finished products and non-food products necessary, supplying the canteens concerned, as well as planning, production and distribution of meals with the equipment of the customer).

For the aforementioned management systems, the reference must be made to all the aforementioned essential phases (including by means of attestation with an authenticated signature by the issuing body), or the equivalent certificates issued by bodies established by other Member States.

Minimum levels of technical and economic capacity are justified:

— the entity, the complexity, the specificity of the contract and the necessary experience and reliability that must be owned by the economic operators wishing to participate in the tender, it being understood that, in case of RTI, it is necessary to specify the phase / part / quota performed from the single economic operator of the analogous service,

— by the fact that the tender relates to a first contract with the possibility of any additional contracts with an annual duration, with a negotiated procedure, in the period up to the following 3-year period,

— from the objective complexity of the service to be carried out in military structures - even minors - spread throughout the country.

The technical capacity requirements must be possessed by:

— R.T.I. or from the consortium as a whole, in case of participation in R.T.I. o Ordinary consortium of competitors pursuant to art. 45, paragraph 2, lett. e) of Legislative Decree no. 50/2016,

— Consortium or, where indicated, by the consortium companies indicated which executori, in the case of consortiums of which to the art. 45, paragraph 2, lett. b) and c) of Legislative Decree no. 50/2016.

The Administration reserves the right to dispose of technical inspections at the premises, even secondary, of competitors, to verify their technical capacity.

a) The procurement procedures referred to in this announcement have been authorized - pursuant to art. 32, co. 2, of Legislative Decree no. 50/2016 - with determines to contract n. 968 R.U.A. on 05.12.2018.

b) The competition will be carried out according to the procedures established by the Legislative Decree n. 50/2016 and will also be awarded in the case of a single offer valid for a single lot.

c) Applications for participation (stamped by € 16.00 if formulated in Italy) indicating the lot or lots to which you intend to participate, under penalty of exclusion from the tender, must:

— to reach the General Command of the Carabinieri Army - Single Contractual Center located in Viale Romania n. 45 - 00197 Rome, together with all the required documentation, within the peremptory period indicated in para. IV.3.4), exclusively to the address P.E.C. crm42527@pec.carabinieri.it. All files transmitted - under penalty of exclusion - must be digitally signed by the competitor's legal representative. The foreign economic operator whose legal representative does not have a digital signature can send - always to the above mentioned address P.E.C. - original documents duly scanned and digitally signed by the legal representative of another company connected to it. The competitor will be able to pay the stamp duty by payment via F24, indicating the code "2501" called "stamp duty", pursuant to art. 6 of the Decree of the Ministry of the Economy and Finance on 17.06.2014. The payment receipt must be sent together with the remaining documentation;

— indicate if it participates in single or associated form (for example in R.T.I., consozio, etc.);

vbe made with the signature of the legal representative, provided with the necessary powers or by a proxy with special power of attorney conferred by a public deed or private deed authenticated by the notary, to be produced together with the application (in the case of establishing RTI or aggregations between companies participating in the contract of the network, refer to the provisions of para III.1.3);

— enclose all the documentation prescribed in para. III.2 (Conditions of participation) digitally signed, with regard to each competing company (even if reunited, consortium, auxiliary or retista participating in the tender);

— indicate the domicile elected for communications (even if it coincides with the registered office), the certified e-mail address and the telephone number (possibly also a mobile phone number) of the competitor. Competitors located in other Member States must indicate the e-mail address to be used for the purposes of communications pursuant to art. 76, paragraph 5 of Legislative Decree no. 50/2016. It should be noted that pursuant to art. 52 of Legislative Decree no. 50/2016, when the economic operator submits the offer on the telecommunication platform, he will automatically elect domicile in the specific "Communications Area" reserved to him, for the purpose of receiving any communication concerning this procedure.

They do not bind the Administration of Defense.

It is recommended to specify in P.E.C. the object of the tender (as indicated in point II.1.1.).

The SIR Sistemi Italiani Ristorazione Srl, on 7.1.2019, it brought an appeal to the TAR Lazio, with contextual precautionary application, for the annulment of the notice of contract, of the determines to contract and of all the assumed, related and consequential acts relating to the procedure in subject.

The Lazio TAR — section First bis, by Decree No. 55/2019 issued on 8.1.2019, upheld the precautionary application submitted by the aforesaid company with the aforementioned appeal, establishing the collegial treatment in the Council Chamber of 23.1.2019.

The abovementioned court, by judgment No. 1168/2019 dated 23.1.2019, published on 30.1.2019, upheld the application by annulling the contested notice and all the acts which it achieved.

Therefore, by Decree No. 164 RUA dated 5.3.2019, this contracting station annulled all the contested acts.
