Pursuant to art. 35, paragraph 4 of Legislative Decree no. 50/2016, the maximum value of the contract is equal to € 3.926.875,00 excluding VAT, since the Administration will be able to commission the successful bidder, through the stipulation of specific implementation contracts for the entire duration of the framework agreement and within the maximum limit established therein. In this regard, it should be noted that:

- there is no obligation for the contracting authority to stipulate the descendant implementation contracts (eg in the event of unsatisfactory execution of the supply);

- the contracting economic operator is obliged to perform the services under the same original technical and economic conditions (price invariance, except as provided in letter h) of the following paragraph VI.3).

Capacità tecnica e professionale:

all economic operators wishing to compete must produce, together with the remaining documentation provided for in this notice and in the tender regulations, under penalty of exclusion from the tender, the following documentation:

- UNI EN ISO 9001-2015 quality certification, currently valid, issued by an accredited ACCREDIA body or other body of mutual recognition to the participating company or the manufacturing company it represents, relating to the IAF19 and IAF34 accreditation sector: "Design , assembly, sale, maintenance, repair and calibration of fixed and portable instruments for monitoring and analyzing gas, dust, water and other physical and chemical quantities ";

- validity certificate of approval of the breathalyser object of the supply, issued by the Ministry of Infrastructure and Sustainable Mobility - Superior Research Center and Motor Vehicle Testing of Rome, pursuant to art. 3 of the Ministerial Decree May 22, 1990 n. 196.

If the competitor does not produce a copy of the documentation indicated in this paragraph, he must submit a suitable self-certification, signed by the legal representative or by an attorney with the necessary powers to represent him (joint signature of the legal representatives of the companies gathered in the case of forming a RTI), drawn up pursuant to and for the effects of the DRP n. 445/2000, with the procedures set out in art. 38, paragraph 3, which certifies its possession. In the case of consortia, the technical-professional capacity requirements required for participation in this contract must be possessed by the consortium itself, pursuant to art. 47, paragraph 1 of Legislative Decree no. 50/2016.
