a) The procurement procedures referred to in this announcement have been authorized - pursuant to art. 32, co. 2, of Legislative Decree no. 50/2016 - with determination to contract n. 526 R.U.A. on 02.05.2022.

b) The tender regulations, which contain all the conditions of participation, together with the relative attachments, the technical documentation and the draft of the contract are available, together with this announcement, on the website www.carabinieri.it, in the "transparent administration" section , sub-section "calls for tenders and: http://www.carabinieri.it/in-vostro-aiuto/amministrazione-trasparente/gare-appalto/gare-appalto/demolizione-e-ricostruzione-della-palazzina-ex-cinema-della-caserma-e.-frate-di-campobasso and on the website www.acquistinretepa.it (initiative name: Executive planning and safety coordination services at the Frate di Campobasso Barracks - initiative number / code: 3207453 accessible from the "sell" menu, subfolder "other calls").

c) The entire contractual execution cannot be subcontracted. Given the nature of the service, subcontracting is allowed - pursuant to the combined provisions of Articles 31, paragraph 8 and 105, paragraph 2 of Legislative Decree no. 50/2016 and as better illustrated in the ANAC Guidelines no. 1 - only for activities relating to geological, geotechnical and seismic surveys, surveys, surveys, measurements and staking, preparation of specialist and detailed documents, as well as for the sole graphic editing of design documents. The economic operator may entrust to third parties specialized consultancy activities relating to the energy, environmental, acoustic and other sectors not related to the disciplines of engineering and architecture for which specific certifications or skills are required.

d) The D.U.V.R.I. has not been drawn up due to the absence of interference.

e) The Tender Identification Code attributed to this proceeding by the A.N.AC. is: 92481896FD.

f) The unique project code (C.U.P.) attributed to this proceeding is: D31B21009040001.

g) The tender was not divided into functional lots due to the homogeneity of the service being acquired.

h) This call for tenders has been sent for publication in the Official Gazette. to the Publications Office of the European Union on 27 September 2022.

i) Being a call for tenders published after 27.01.2022, pursuant to art. 29 of Legislative Decree 27.01.2022 n. 4, in order to deal with the negative economic repercussions following the containment measures and the global health emergency deriving from the spread of the COVID-19 virus, a price revision clause will be included in the negotiation act that will arise from this procedure. pursuant to art. 106, paragraph 1, let. a) of Legislative Decree no. 50/2016. With Decree n. 1382 U.A.R. of 30.11.2022 was annulled, in self-protection, the determination to contract n. 526 U.A.R. of 02.05.2022, together with the call for tenders published in the G.U.U.E. no. 2022/S 189-534624 of 09.30.2022 and on the G.U.R.I. – 5th Special Series Public Contracts n. 114 of 09.30.2022, as well as the prerequisite and consequential deeds, since:

- the National Council of Engineers, with note no. U-nd/10133/2022 of 06.10.2022 has, among other things, noted that the basic tender amount has been underestimated, since it did not consider some services of the final design level and, therefore, highlighted that the tender of the tender violates the principle of fair compensation, as also clarified by the ANAC with its press release dated 11.05.2022;

- the press release of the President of the ANAC of 05.11.2022 provided "Indications regarding the calculation of the basic tender amount for the assignment of architectural and engineering services, in the case of omission of the planning levels pursuant to the article 23, paragraph 4 of the contracts code”, clarifying that, for the purposes of calculating the remuneration to be paid to the designer, the Contracting Authority must in any case determine and list in detail all the services required, relating to the individual design levels. This is because "the merger of the project levels does not involve the reabsorption of the remuneration of the service attributable to the omitted levels nor that of the corresponding service performed at the executive level", thus safeguarding the principle - constitutionally guaranteed - of fair compensation, aimed at ensuring a remuneration proportionate to the quantity and quality of the requested service;

- the Engineering Works Directorate of the General Command of the Carabinieri found some of the findings made by the National Council of Engineers with the aforementioned note well founded and, therefore, proposed to act in self-protection by proposing the cancellation of this procedure;

- the call for tenders, at let. k) of section VI.3), expressly provides for the faculty for the Administration to suspend, reinstate or revoke the tender with justification;

- the combined provisions of articles 21-octies and 21 nonies of Law 08.07.1990 n. 241, provides that the administrative provision adopted in violation of the law can be annulled ex officio, if the reasons of public interest exist;

- the Selection Board has not yet been appointed and, therefore, the tenders have not been opened and/or examined;

- given the findings of the National Council of Engineers, there is a concrete and current public interest in the cancellation of this tender procedure.
