Pursuant to art. 35, paragraph 4 of Legislative Decree No 50/2016, the maximum value of the contract is equal to EUR 8 822 950.81 excluding VAT, since the Administration will be able to commission the successful bidder, through the stipulation of specific implementation contracts and for the entire duration of the framework agreement, more supplies within the maximum limit established. In this regard, it should be noted that:

— there is no obligation for the contracting authority to stipulate the descendant implementation contracts (eg in case of unsatisfactory execution of the supply);

— there is the possibility of modifying the quantities in supply (within the maximum quantity foreseen), based on the discounted needs and/or future financial resources;

— the contracting economic operator is obliged to perform the services under the same original technical and economic conditions (price invariance).

Each competitor must be registered in the register of companies held by the competent chamber of commerce for industry, crafts and agriculture, with the Ateco classification of the activity having the following codes:

— 22.2 (manufacture of plastic articles) and/or 32.99.12 (manufacture of plastic articles for personal safety);

— 32.99.14 (manufacture of gas masks) and/or 32.99.12 (manufacture of plastic articles for personal safety).

The competitor not established in Italy but in another Member State or in one of the countries referred to in art. 83, paragraph 3 of Legislative Decree No 50/2016, must be registered in the competent register of companies and carry out the same activities in accordance with the aforementioned Ateco codes, which must be specifically indicated in the corporate purpose of the relevant chamber certificate. Furthermore, all competitors (even if they are consortium members, reunited, networkers or auxiliaries) must declare that they possess the general requirements, economic-financial and technical-professional capacity required for participation in the tender, according to the procedures indicated in the specification. of race.

Capacità tecnica e professionale:

All economic operators who intend to compete must produce, together with the remaining documentation provided for in this announcement and in the tender regulations, under penalty of exclusion from this tender procedure, the certification of their quality management system in accordance with UNI EN ISO 9001-2015, currently valid, issued by an accredited body and referring to sector EA/IAF 14 or 29, in which the description of the activity/process/product must specifically refer to the design/production of protective helmets and to that of gas masks (in the event that the EA/IAF accreditation sector of the participating company is 29, the description of the activity/process/product must be relevant to the subject of the contract ‘helmet/mask for public order’). In case of R.T.I. the aforementioned certification must be owned by at least one company. If the competitor does not produce a copy of the documentation indicated in this paragraph, he must submit suitable self-certification, signed by the legal representative or by an attorney with the necessary powers to represent him, drawn up pursuant to and for the purposes of the D.R.P. n. 445/2000, with the procedures set out in art. 38, paragraph 3, which certifies its possession. In the case of consortia, the technical-professional capacity requirements required for participation in this contract must be possessed by the consortium itself, pursuant to art. 47, paragraph 1 of Legislative Decree No 50/2016.
