Descrizione delle opzioni:

Pursuant to art. 35, paragraph 4 of Legislative Decree no. 50/2016, the maximum value of the contract is equal to EUR 5 660 400.00 excluding VAT, since the Administration will be able to commission the successful tenderer, through the stipulation of specific implementation contracts and for the entire duration of the framework agreement, more supplies within the maximum limit established in the framework agreement. In this regard, it should be noted that:

— there is no obligation for the contracting authority to stipulate the descendant implementation contracts (e.g. in case of unsatisfactory execution of the supply),

— there is the possibility of modifying the quantities in supply (within the maximum quantity foreseen), based on the discounted needs and / or future financial resources,

— the contracting economic operator is obliged to perform the services under the same original technical and economic conditions (price invariance).

All economic operators provided for by art. 45 of Legislative Decree No 50/2016, including competitors specifically and temporarily grouped pursuant to art. 45, paragraph 2, lett. d) of Legislative Decree No 50/2016 and aggregations between companies adhering to the network contract pursuant to art. 45, paragraph 2, lett. f) of Legislative Decree No 50/2016, according to the procedures indicated in the tender regulations.

Capacità tecnica e professionale:

Companies and/or groupings and/or networks specialized in the production of the products for which they are applying to compete are allowed to participate. To this end, each competitor must declare / demonstrate possession of the following minimum requirements:

(a) certification certifying compliance with the UNI EN ISO 9001-2015 standards, currently valid, issued by an accredited ACCREDIA body or another body in mutual recognition, relating to the reference sector IAF 04, or self-certification by the legal representative or a proxy having the powers necessary to represent them, drawn up pursuant to and for the purposes of the DPR n. 445/2000 and with the procedures set out in art. 38, paragraph 3 certifying its possession;

(b) specific turnover: list of supplies made in the 3-year period 2018-2020, relating to finished products similar (for construction techniques, similarity and intended use) to those under contract, whose annual average must be at least EUR 1 074 283.20. The list must contain a detailed indication of the type of products, amounts invoiced, dates of contracts and beneficiaries.

The Administration reserves the right to arrange technical inspections at the competitors' premises, including secondary ones, to verify their technical capacity. The related costs are borne by the competitor.

The minimum levels of technical and economic capacity are justified by the objective complexity of the supplies (in terms of procurement and delivery times of finished products, especially for the request for any ‘5th urgency’ or ‘additional 5th’).
