Abilitazione all'esercizio dell'attività professionale:

Partecipation to the present tender is subordinated to the presentation of all requirement shown in correspondence of the ppr_10255 which can be found at the following main address: https://globalprocurement.enel.com/tenders-and-opportunities

1) Participation Model (Modello partecipazione gara) to be used in order to comply with the points III.1.2 and 1.3. The model contain, also the declaration to accept, without any conditions or reservations, all the rules and provisions contained in the tender notice;

2) Human right declaration model (Modello Dichiarazione dei Diritti Umani);

3) Final final beneficial owner model;

4) ESPD;

5) Addendum to ESPD;

6) Informations regarding company legal representative and type of participation to the tender (i.e. Single company, Temporary grouping of companies/temporary association of companies (RTI/ATI) or Availment) as per art. 89del D.Lgs 50/2016 codice appalti – avvalimento and art. 105 del D.Lgs50/2016 codice appalti –subappalto in case of subcontract;

7) Statement attesting that the company can participate in a tender as per dell'art. 80 e s.m.i. del D.Lgs 50/2016 ed smi;

8) Statement attesting non-existence of any form of control/relation between companies participating to the same tender in case of the above mentioned situation implies that the offer is imputable to a single decision-making center as per art. 2359 C.C;

9) Certificate of registration to the ordinary section of the Companies Register issued by the Chamber of Commerce for activities related to those of the tender certifying that the company is not in a state of bankruptcy, compulsory liquidation, arrangement with creditors or against whom there is an on-going process for the declaration of one of these situations (in addition to the certificate, a further document must be submitted which shows that the signatory/signatories has/have been granted the related power, in cases in which this is not evident in the certificate issued by the Chamber of Commerce).

Declarations at the points 7,8 are included into the European Single Procurement Document (ESPD) Italian version DGUE. To comply with the requirement at the point 8, the relevant document is ‘Autodichiarazione iscrizione Camera di Commercio’ – ‘Self-Statement of registration to the chamber of commerce’.

With reference to the application terms, how to participate, time bar and general information please note points IV.2.2) and VI.3

In case of RTI, request of participation have to be submitted by the representative company of the group and to contain documents and declarations by all the components of the group as per above mentioned list.

All the documents/declaration must be filled considering Euro as main/unique currency.

Posizione economica e finanziaria:

Partecipation to the present tender is subordinated to the presentation of all requirement shown in correspondence of the ppr_10255 which can be found at the following main address:

List and brief description of selection criteria:

Document list/declaration required:

Participation is reserved to the subjects which are in possession of the economic/financial requirements demonstrable trough the presentation of relevant documentation as per attachment 1 of the ppr_10255 which can be found at the following main address:

10) Bank references (almost 1 declaration);

11) Net revenues for the years 2018-2019 derived from approved statutory financial statements. For eligibility to the tender, the overall figure for the 2-year period in question will be not less than EUR 10 000 000.00 (10 millions). Annual report to be considered net of discounts, rebates, returns, adjustments and with exclusion of different, extraordinary and financial proceeds, which can be allocated in the extra-feature management;

12) An amount not less than EUR 6 000 000.00 in the relevant supply segment, failing which figure will entail exclusion from the tender. A statement regarding sales in 2020 will be accepted if sum of the invoices can reach same amount. Company can be requested to show the relevant invoices;

13) Latest available annual report (Ita or Eng Language);

14) List of the most important contract — referred to point 11 above — carried out in the same 2-year period.

In order to comply with points III.1.2) and III.1.3) company have to use the model ‘tender participation ppr_10255’ with relevant attachment.

For the purpose of presenting the application read the instructions at the point IV.2.2) and VI.3).

In case of RTI or any other form of collaboration, declaration have to be made by all the members.

Requirements at the points 6 and 7 are divisible between the members with the minimum share of 20 %.

All the documents/declaration must be filled considering Euro as main/unique currency.

Livello(i) minimo(i) di standard:

13) Self declaration certifying the capacity to deliver all the 280 laser scanner in 12 months.

Capacità tecnica e professionale:

1) The participant must have produced and/or distributed in the last three years prior to the publication of the call for tenders, instrumentation for measuring precision topographic quantities. If the participant is not in possession of this requirement, he must declare to be in possession of a design and construction structure capable of developing and marketing measuring instruments for precision topographic quantities;

2) The product must have the CE marking;

3) Enel will evaluate the Laser Scanner + Software during a Technical Conformity Assessment (TCA) that will verify its possible approval with Enel's Technical Specifications shared into first phase of the tender during which it may also be required to provide a prototype;

4) Participation in this tender procedure is also subject to the sending of a confidentiality agreement dated and signed by a legal representative drawn up in accordance with Annex 1 (Non disclosure Undertaking) which cannot be modified and is available in the notices and tenders section of the portal Enel purchases https://globalprocurement.enel.com/tenders-and-opportunities at the reference ppr_10255;

5) Self-declaration certifying the possession of a structure capable of guaranteeing the coordination and implementation activities; (in case of distributor declaration to be made on behalf of the constructor);

6) Self-declaration of existence of an adequate structure for the after-sales assistance service carried out in compliance with the ISO 9001 standard;

7) Self-declaration of possession of the company quality management system (QMS) compliance certification in the current edition of the ISO 9001 standard issued by an accredited certification body (participant in EA or IAF agreements). The aforementioned self-declaration must indicate the commitment to maintain the certification of ISO9001 for the entire duration of any contract;

8) Self-declaration of commitment to deliver the object of the tender in case of awarding;

9) Self-declaration certifying the production capacity or distribution capacity of at least 50 Laser Scanner + Software per month, also indicating the maximum production capacity;

10) Commitment by the supplier to deliver the lot assigned to him no later than 5 months from awarding max 1 months for technical conformity assessment + 4 months for delivering after purchase order.

11) Possession of the ISO 9001 Certificate;

13) Possession or commitment to obtain ISO 45001 Certification within 12 months after awarding date;

14) Possession or commitment to obtain ISO 14001 Certification within 12 months after awarding date.

For the requirements referred to in points III1.2) and III.1.3) the competitor must use the «tender participation form available both in italian and english with the relative attachments.

The English version to be considered as a courtesy copy, the Italian version have to be filled and signed.

Documentation made by Italian suppliers have to be signed using digital signature released by a subject registered in the list of art. 29 D.Lgs 82/2005 and with timestamp. As far as the other suppliers concern, documentation have to be submitted digitally signed (in respect of the law of the country of origin) or anticipated via e-mail and sent by post if digital signature ain’t available. Failure total or partial documentating the requirements may constitute grounds for exclusion from the tender. Once declared, it can be subsequently proved during the tender phase. For the purpose of presenting the application, read the instructions, procedures and times indicated in section IV.2.2) and VI.3). Enel reserves the right to conduct the economical phase on the Webuy on-line tender IT system, Which can be accessed by connecting to Enel Group Procurement Portal. In case of Temporary association of Companies or any other form of cooperation, the application form must be submitted by the mandatory representative company and the documentation have to be filled by all the companies in the above mentioned association.

Enel reserves their right to admit to the tender companies in pooling contract (RTI).

Condizioni di esecuzione del contratto:

Personal data will be managed according to general data protection regulation ‘GDPR’ (EU-2016/679), collected and processed in an automated and paper form, as well as (in the case in which the appropriate consent is given) for activities of promotion of commercial services, or to implement the obligations provided by law. With object ‘Bando Europeo gara ppr_10255 domanda di partecipazione – Global Procurement — Global I&N Procurement — Smart Grids Materials and Equipments Procurement’, suppliers. Suitable suppliers will be invited to participate at the Online tender throught the platform called WEBUY.

Registration procedure to WEBUY and to the merceological group called ‘FSMT13 - Strumenti per misura di grandezze topografiche’ must be completed within end of the economic phase if not participant cannot be awarder.

For the registration procedure please follow the instruction in the website https://globalprocurement.enel.com/become-a-supplier.

In case of needs please contact the helpdesk: https://globalprocurement.enel.com/contacts. In case of In case of Temporary association of Companies or any other form of cooperation, the above mentioned registration must be done by everyone.

Participant have to:

— fill and digitally sign the NDU and to send it to the above mentioned contacts in order to get technical specification. In the case of a RTI, the NDU must be jointly signed,

— upon receipt of the request of participation Enel will allow the supplier to discharge/upload the documentation of the first phase of the tender which can be identificated with the code rfi_281.

The qualification process to the FSMT13 must be (at least) in the status ‘invio base positivo’ if not participant cannot have access to the documentation.

It is absolutely forbidden to send technical and economic offers during the present pre-qualification phase, under penalty of exclusion from the tender. Documentation must be uploaded within the deadline of present announcement into the rfi_281.

All the documentation have to be submitted in Italian/English language.

Total/partial failure to comply with previous points can constitute an exclusion to the relevant tender.

In case supplier will be considered suitable for this tender he will have access to the Other phases of the tender.

Participation to the tender is also subordinated to the presentation of the documents required into relevant merchandise group.

Euro is the only one accepted currency.

It is also required:

The supply of each laser scanner device must include the software license.

A 5-year warranty with assistance is required.

Assistance from the supplier may be requested for problems related to:

— software of devices and scan processing software and related upgrades (upgrade available and automatically installed at each release),

— device firmware,

— technical support in case of problems during use.

Product warranty must also ensure:

— failures attributable to manufacturing defects

— hardware repair under warranty and not, with return within 1 month,

— the possibility to report failures via telephone/email, with response and start of resolution activities within 2 working days,

— the licenses must be concurrent, installable on the Amazon Cloud and in an adequate number in order to guarantee 90 users contemporaneity,

Training is also required that includes:

— user manuals and videos in Italian language,

— technical documentation relating to the use of the device,

— a least 4 specific training sessions in Italy with object the laser scanner and their software.

Enel reserves the right to exclude from the tender suppliers who, at the time of submission of the application for participation in the tender, have not completed the requirements for obtaining authorization to access the WEBUY platform for the FSMT13
