Criteria for qualitative selection of subcontracts prescribed by the contracting authority/entity and other criteria which the successful tenderer will apply for the selection of the subcontractors and the assessment of their bid proposals:

Subcontractors from states other than those specified in Art. 131d paragraph 1 of the act dated 29.1.2004 public procurement law (J.L. from 2013, item 907, as amended) (‘Polish Public Procurement Law’) can participate in the proceedings as per Article 131d, paragraph 2 of the Polish Public Procurement Law.

In accordance with Polish Public Procurement Law and the announcement for the supply of the Integrated Advanced Training System (the AJT) issued by the Armament Inspectorate, the subcontractor shall provide the following documentation:

1) Subcontractor's declaration on meeting the requirements for participating in the proceeding as referred to in Art. 22 section 1 of the Polish Public Procurement Law;

2) Subcontractor's declaration on lack of basis for exclusion from the proceeding on the basis of Art. 131e section 1 items 1-5 of the Polish Public Procurement Law;

3) a current, relevant security clearance or industrial security certificate that warrants the capability of protecting classified information marked at least as ‘Confidential’ as referred to in the Act dated 5.8.2010 on classified information protection, dated (J.L. No. 182, item 1228);

4) current extract from the relevant register or a central business register or data base if separate regulations require a register or data base entry to show that there is no ground for exclusion on the basis of Art. 24 section 1 item of the Polish Public Procurement Law, issued not earlier than 6 months prior to expiration of the deadline for submission of requests for participation in the proceeding for the contract award procedure;

5) current certificate from the relevant head of the tax office confirming that the subcontractor is not behind with tax payments or a certificate stating that it has been granted a legal exemption, deferment or arrangement for paying overdue payments in instalments or a total suspension of execution of a decision made by an adequate body, issued not earlier than 3 months prior to expiration of the deadline for submission of requests for participation in the proceeding for granting the subcontract;

6) current certificate of the appropriate branch of the Social Insurance Institution (ZUS) or the Agricultural Social Insurance Fund (KRUS), confirming that the subcontractor is not in arrears with paying of the contribution for the health and social insurance or a certificate confirming that it has been granted in accordance with the law an exemption, deference or permit for payment in instalments of overdue payments or a decision of the competent authority of a total suspension of execution of a decision made by an adequate body, issued not earlier than 3 months prior to expiration of the deadline for submission of requests for participation in the proceeding in the subcontract award procedure;

7) current information from the National Criminal Record in the scope specified in Art. 24 section 1 items 4–8 of the Polish Public Procurement Law t, issued not earlier than 6 months prior to expiration of the deadline for submission of application for admission in the proceeding for granting the subcontract;

8) current information from the National Criminal Register in the scope specified in Art. 24 section 1 item 9 of the Polish Public Procurement Law, issued not earlier than 6 months prior to expiration of the deadline for submission of application for admission n the proceeding for granting the subcontract;

9) current information from the National Criminal Register in the scope specified in Art. 131e section 1 item 2 of the Polish Public Procurement Law, issued not earlier than 6 months prior to expiration of the deadline for submission of application for participation in the proceeding for granting the subcontract;

10) a paid-up insurance policy, and if no such policy exists, a different document confirming that the subcontractor has third party liability insurance relating to the activities performed by it within the scope of the contract, for an amount at least equal to the value of the part of the contract entrusted to it by the contractor;

11) a certificate confirming that the Subcontractor has a deployed quality management system, compliant with ISO/AS 9100.

If, for a subcontractor that has its registered office in the Republic of Poland, the entities referred to in Article 24 section 1 points 5–8 of the Polish Public Procurement Law, have their places of residence outside the Republic of Poland, concerning such entities the subcontractor should submit certificates from the court or administration authorities competent for their places of residence, concerning their lack of criminal record in the scope determined in Article 24 section 1 points 5–8 of the Polish Public Procurement Law, issued not earlier than 6 months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure, it being specified that if no such certificates are issued in their places of residence, they may be replaced by documents containing statements made before the competent court or administration authority, or a self-governing professional or business authority in the place of residence of such entities, or before a notary.

If a subcontractor has its registered office or place of residence outside the Republic of Poland, then instead of the documents referred to above in:

— points 4–6 and 8 – it should submit a document or documents issued in the country where it has its registered office or place of residence, confirming, respectively, that:

d) it is not under liquidation and it has not been declared bankrupt – issued not earlier than six months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure;

e) it is not in arrears with the payment of taxes, fees, contribution towards the health and social security funds, or that it was granted, in accordance with the law, an exemption, deferred payment or payment by instalments of the outstanding payments or a decision of the competent authority has been suspended in full – issued not earlier than 3 months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure;

f) it has not been prohibited from participating in the contract award procedure – issued not earlier than 6 months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure;

— point 7 – it should submit a certificate from the court or administration authority competent for the registered office or place of residence of the entity concerned, in the scope determined in Article 24 section 1 points 4–8 of the Polish Public Procurement Law – issued not earlier than 6 months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure;

— point 9 – it should submit a certificate from the court or administration authority competent for the registered office or place of residence of the entity concerned, in the scope determined in Article 131e section 1 point 2 of the Polish Public Procurement Law – issued not earlier than 6 months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure;

— point 3 –- it should submit a security clearance granting authority to access classified, international information of NATO and EU – issued not earlier than 6 months before the lapse of the deadline for submitting applications for admission to participate in the contract award procedure.

If the documents referred to in items 3–9 are not issued in the country where the subcontractor has its registered office or its place of residence, they should be replaced with a document containing a statement, in which the people authorised to represent the subcontractor are also specified, made before the relevant court, administrative body or a body of the local professional or business authority relevant to the place of residence of the person or the country where the subcontractor has is registered office or the place of residence, or made before a notary, and issued in the deadlines specified above.

The documents should be submitted as originals or as copies certified by the subcontractor.

The Contracting Entity reserves itself the right to demand to be provided with an original or a copy of the document certified by a notary, if the submitted copy of the document is illegible or raises concerns as to its authenticity.

Documents drawn up in foreign languages should be submitted together with their translations into Polish.

1. The Subcontractor shall be required to complete and sign the Alenia Aermacchi Proprietary Information Agreement prior to receiving the RFQ.

2. Provide your company's capabilities brochure which and provide details of your ability and knowledge in the area of training courses.

3. Provide a description of past performance work done that would support your capabilities to perform the required translation activities on CAI/CBT materials for a Jet trainer aircraft.

4. Provide copy of any type of additional certification that may support your capability to engage in economic activity in the field of manufacturing and marketing of product in the Defence field.

5. Provide a statement that you accept and comply with the Alenia Aermacchi code of ethics which is available at the folling link:

6. The Contracting Entity reserves itself a right to terminate the proceedings at any time without selecting the most advantageous offer or executing the subcontract in case an offer has already been selected. The reasons for termination of the proceedings may include, without limitation: a suspension or termination of the public procurement contract for the supply of the Integrated Advanced Training System (Advanced Jet Trainer) for the Polish Air Force by the Armament Inspectorate or if for any reason no offer is selected in this proceeding.

7. Any costs related to participation in the proceedings shall be borne by the potential subcontractors and in no case shall the Contracting Entity bear any liability towards such potential subcontractors in relation to their participation in the proceeding, including without limitation the earlier termination of the proceeding.
