Condizioni di partecipazione
Abilitazione all'esercizio dell'attività professionale:

1) Absence of grounds for exclusion under Art. 38, D. Decree 163/06 and subsequent modifications and integrations;

2) the absence of forms of control, pursuant to art. 2359 C.C. , with other independent tender participants;

3) the non-coincidence, even partially, with other independent tender participants, members of the boards and representation, and the parties signatory to the tender documents;

4) commitment, in the offer, to issue a declaration, signed by the legal representative, stating what follows, listing the items of interest:

— to be in compliance with the rules governing the right to employment of people with disabilities with particular reference to Law No. 68 of 12.03.1999 and in particular:

— to have a workforce of less than 15 units,

— to have a number of employees between 15 and 35 and…

… not making new hires since 2000,

… have made new hires in 2000,

— to have a number of employees over 35,

— to have used individual plans of emerging from the shadow economy under the Law 383 of 8.10.2001 and the like but ended the period of emergence,

— to have not used individual emergence plans of the shadow economy provided by Law No 383 of 18.10.2001 and to be aware of the fact that Article 1 bis, paragraph 14, the same law, as stated in art. 1 paragraph 2 of D. L. No 210, 25.09.2002, converted into Law 266 of 22.11.2002, which provides for the exclusion of tenders until the end of the period of emergence,

— to not be subject to the application of a disqualification sanctions under Article. 9, paragraph 2, letters a) and c) D. Decree No 231 of 08.06.2001 and similar;

— the regularity of legal requirements and contractual obligations relating to employment relationships of its employees, in particular as regards the regularity of contribution payments and obligations in social security, welfare and insurance against INPS, INAIL and Building Fund,

— the regularity of the obligations relating to health and job security for its own employees,

— the absence of possible conflicts of interest or potential conflicts of interest of the competitor with the Enel Group company, resulting from an examination of the composition of the company in the qualification which shows the presence of people who hold, in the company of this Group, a role of top management, and / or employees of the companies (including their relatives up to second degree), and / or beneficial rights on the shares or guarantee with the right to vote or trust companies and parent Companies,

— the availability of the competitor to adhere to specific ethical and social obligations (eg. measures to ensure respect for workers fundamental rights, the principles of equal treatment and non-discrimination, protection of child labor, etc..) And accept controls at its factories and offices, in order to verify the fulfillment of those requirements;

— a declaration of ex special part D "Offences against the person" in particular:

— declaration of being / not being investigated over the past 5 years in legal proceedings related to the following offenses against the person: reducing or holding in slavery or servitude, child prostitution, child pornography, possession of pornographic material, tourism aimed at exploitation of child prostitution, trafficking, sale and purchase of slaves,

— possession of technical and professional eligibility requirements pursuant to Art. 26, paragraph 1, point a) 2) of Legislative Decree No 9 April 2008 81; Declaration of company personnel with technical skill in mechanical engineering, with traning certificates for maintenance of diese engines MTU series 1600-2000-4000; curriculum staff;

5) copy of registration in the register of the Chamber of Commerce, Industry and Agriculture or the Register of provincial committees for the craft, or foreigner residing in Italy, in the professional register of the State of residence;

6) possession of a quality system certification complying with UNI EN ISO (ISO 9001:2000);

7) adoption and implementation of a Safety Management System that meets the international OHSAS 18001 or equivalent.

8) have suitable bank references;

8.1) have performed over the past three years from 2010 - 2011 - 2012, at least one supply of similar type, in operation for at least a year to the satisfaction of the customer. List of supplies in work performed in the 2012 showing the following information: the object detail, the amount, the customer, the location and date of commencement and completion of works; Enel reserves the right to request certificates of satisfactory execution of works. For the conversion, it must be adopted the conversion value of the average rate of the Italian exchange (UIC) for the month of June each year in question;

9) availability of internet access and e-mail address (bids, both technical and general data and economic data must arrive via internet on our computer system Ariba Enterprise Sourcing), during the tender will be required to register (RFI) and / or qualification (RFQ) for the merchandise groups of interest to Enel Purchasing Portal (website www.acquisti.enel.it);

10) to have the potential to guarantee the proper execution of work;

11) commitment, if awarded, to provide complete and detailed information on properties and corporate bodies of the company and any parent companies (excluding listed companies), to trace the names of individuals in possession of the individual shares. Minimum conditions for joined companies:

A) apply the provisions of art. 37, D. Decree 163/2006

B) all joined companies must have the individually requirements set out in paragraphs 1-2-3-4-5-6-7-8

C) the requirements set out under 8.1 point must be met by the whole group and in particular: - by the agent / group leader for not less than 60% - from each of the other members of the group by not less than 20%;

D) the requirements of paragraph 9 should be possessed by the agent / group leader;

E) the declaration of commitment referred to paragraph 11 should focus on the agent and the principals of RTI, the consortium and any consortium. Common provisions for individual firms and joined companies: in the request for participation will be considered sufficient if the companies produce statements, just signed on to all the requirements, in relation to section 9 must also be given the e-mail address; the statements should be released, even in cumulative form, in Italian, on letterhead of the companies, stamped and signed by a legal representative thereof, and will highlight the address to deliver any correspondence, as well as phone numbers and fax. The agent, as mentioned above, will also highlight the e-mail address, which deliver any notices in addition to any invitation letter with its accompanying documents; the consortium should also send the list of member companies to the consortia themselves . This declaration must be proven in the manner to be specified in the bid request.

Posizione economica e finanziaria:

Is required a specific percentage turnover related to these tender activities not less than 0,2 MEUR/y and a global turnover not less than 0,5 MEUR/y. (See point III.2.1).

Esecuzione dell'appalto
Depositi e garanzie richiesti:

In case of adjudication, Enel may require the constitution, in the manner prescribed by Enel, of a final deposit up to a maximum of 10% of the contract amount with the company assignee. In case of temporary association of companies the deposit must be made by the main company representative. Will not be accept guarantees from finance companies.

Payment of the related invoices and any spare parts shall be made by bank transfer with fixed value date for the beneficiary on the third last working day of the month in which the term falls of 60 (sixty) days from the date of receipt of those invoices if the invoices are sent by Web EDI and of 120 days if the invoices are sent in a paper format.
