1) This contract notice is subject to Italian Legislative Decree no. 163/06 “ dated 12.4.2006, where applicable in public contracts in special sectors.

2) The candidate, single or as a member of a TAC or a consortium as per art. 34 of Italian Legislative Decree no. 163/06 could comply with economic, financial and technical requirements making use of employment of auxiliary parties (pursuant to what is set forth in art. 49 of the Italian Legislative Decree no.163/06). In this case the bidder has to submit specific documentation listed in art. 2 of the above mentioned article.

3) According to the deliberation of the authority of the surveillance of public works dated January 2006 and to the further statement of its President dated 28.7.2006, it’s stated that the companies which shall be invited to the tender shall be required to pay an amount to the authority of the surveillance of public works as condition to participate to the tender. The companies shall demonstrate providing the offer, to have paid the required amount. The missing demonstration to have paid the required amount shall be reason for exclusion from the tender. The payment of the required amount shall be done according to the instructions present at the following web site: http://www.autoritalavoripubblici.it/riscossioni.html

4) ENEL shall invite bidders to submit the economical bid only in case of positively evaluation of its technical proposal.

5) Minimum period for which the tender is required to keep open the offer: 6 (six) months from the deadline stated for technical offer

6) Companies that, due to gross faults in fulfilling the contract obligations towards ENEL or other companies belonging to the ENEL Group, caused significant damages during the performance of previous contracts, shall be excluded from participating in the tender

ENEL reserves the right, at its sole and unquestionable discretion, to cancel the tender.

7) ENEL also reserves the right to carry out the negotiation by using computerised means (e-commerce). In particular, ENEL reserves the right to use an electronic auction for the award of the contract as per art, 85 of Italian Legislative Decree no 163/06

Note that all the documents requested in previous points for participating in the tender shall be sent at the address specified in this notice in no. 1 original (signed by the company’s representative and his/her identification document shall be included) and no. 1 copy, clearly indicating the tender details on the outer side of the envelope.

In the request to participate the candidates are requested to submit just declarations stating the compliance with all the requirements. The statements will be issued, also as a cumulative declaration, in Italian or English, on business letterhead, stamped and signed by legal representative.

Later in the tender phase the candidates will be asked to demonstrate all the above declarations and in particular to submit the declarations / certificates of satisfactory execution issued by the client of similar works.
